Terms of Service

Welcome to Tommy Labs ("the Store", "we", "our"), operated by Tommy Scruggs / Sun Sponge LLC. These Terms of Service ("Terms") govern your use of tommylabs.store (the "Site") and your purchase of custom 3D printed products from the Store. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. The Products

All items offered for sale are custom 3D printed creations, designed and manufactured by Tommy Labs. Because each item is printed on demand:

• No two items are identical. Small variations in color, layer lines, surface texture, and dimensions are a normal and expected characteristic of 3D printed goods and are not defects.
• Product images and 3D previews are representative. Your item may differ slightly from the preview.
• Colors shown on your screen may vary from the physical print due to monitor calibration and filament batch differences.

2. Orders & Payment

• Placing an order constitutes an offer to purchase. Orders are accepted when payment is successfully processed via Stripe.
• All prices are in US Dollars (USD) and, unless stated otherwise, exclude shipping.
• Payment is processed securely by Stripe. We do not store or have access to your full card details.
• We reserve the right to refuse or cancel any order at our discretion, including orders we suspect of fraud or resale without authorization.
• If an order is cancelled after payment, we will issue a full refund to the original payment method.

3. Custom Orders

Custom order requests submitted through the Site are inquiries, not orders. We will respond to discuss scope, design, timeline, and pricing before any custom work begins. A custom order is binding only once you accept a written quote and pay a deposit or full amount as agreed.

4. Shipping & Delivery

• Items are printed on demand and typically ship within 3–7 business days after payment, unless otherwise noted.
• Delivery times are estimates, not guarantees. We are not liable for carrier delays.
• Risk of loss passes to you when the carrier takes possession of the shipment.
• It is your responsibility to provide a correct shipping address. If a package is returned to us due to an incorrect address, we will contact you to arrange reshipment at your cost.

5. Returns, Refunds & Exchanges

Because items are made to order, we want to make sure you're happy with your purchase. Please see our Refund & Returns Policy for full details. In short:

• Damage in transit or a clear manufacturing defect: we will replace or refund, including return shipping.
• Change of mind: returns accepted within 14 days of delivery, subject to the item being unused, undamaged, and returned at your cost.
• Custom orders: refunds are limited to the terms agreed at quote time, except where required by law.

6. Intellectual Property

• All designs, 3D files, images, text, and other content on the Site are the property of Tommy Labs unless otherwise noted.
• Purchasing a physical item does not grant you any rights to the underlying design files. Commercial reproduction or resale of our designs without written permission is prohibited.
• Third-party trademarks (e.g., Batman) are the property of their respective owners. Products inspired by characters are fan art for personal use; we do not claim ownership of those marks.

7. Use of the Site

• You agree not to misuse the Site, including attempting to interfere with its operation, scraping, or using automated tools to place orders.
• You are responsible for maintaining the confidentiality of any account or contact information you provide.

8. Limitation of Liability

To the maximum extent permitted by law, Tommy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site; (b) any conduct or content of any third party; or (c) unauthorized access to or alteration of your transmissions or data. Our total liability arising out of or in connection with these Terms or your purchase shall not exceed the amount you paid for the product in question.

9. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by law. Nothing in these Terms affects your statutory consumer rights that cannot be limited by contract.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.
